Terms of Service

These terms govern your use of PosPly, a point-of-sale and inventory platform built for phone and electronics shops in the United Arab Emirates and the United Kingdom. By creating an account or using the service, you agree to these terms.

1. Who can use the service

PosPly is a business-to-business (B2B) service intended for shop owners and their authorised staff. It is not intended for purely personal, consumer use.

You must have the legal authority to accept these terms on behalf of your store or business.

2. Account responsibility

You are responsible for the accuracy of your store data, including tax registration details and store address when issuing official invoices.

You must keep your login credentials secure and must not share them with unauthorised parties. You are responsible for all activity by users you invite to your account.

3. Free trial and subscriptions

A 14-day free trial begins once store setup is complete. You can use the till during this period without being locked for lack of a card.

If you save a card during the trial, the first charge is deferred until the trial end date. Cancelling before that date means nothing is charged, and the subscription amount is not held on the card for the length of the trial.

PosPly is a business-to-business (B2B) service. The statutory 14-day consumer cooling-off right after payment does not apply to a shop owner acting in the course of trade; the free trial is the contractual try-before-pay period.

Prices are shown in the currency of the market you select at signup (currently UAE Dirhams). Local VAT may apply depending on your country's rules.

You can cancel your subscription at any time from your dashboard. After a paid invoice, access continues until the end of the period already paid for, with no automatic refund. Details are in the Refund Policy.

4. Acceptable use

You must not use the service for any unlawful purpose, to store stolen or fraudulent data, or to attempt unauthorised access to our systems.

Full details are set out in our separate Acceptable Use Policy, which forms part of these terms.

5. Data ownership and availability

You retain full ownership of your sales, inventory, and customer data. We process it only to operate the service, as described in our Privacy Policy.

We aim to provide a stable service, including offline-capable point-of-sale support where possible, but we do not guarantee 100% uptime due to scheduled maintenance or events outside our control.

6. Limitation of liability

The service is provided "as is" to the maximum extent permitted by law. We are not liable for indirect, consequential losses, or business interruption arising from use of the service.

Our total liability to you is limited to the fees you paid for your subscription in the twelve months preceding the claim, to the extent permitted by law.

7. Account termination

You may terminate your account at any time. We may suspend or terminate access to the service for material breach of these terms or our Acceptable Use Policy.

When your account is terminated, you may request a copy of your data within a limited period before it is permanently deleted, as described in our Privacy Policy.

8. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email or within your dashboard before they take effect.

9. Governing law

These terms are governed by and construed in accordance with the law of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales, regardless of conflict of law principles.
